Acceptance of Terms and Conditions. By accessing our website or making a purchase, you acknowledge that you have read, understood, and are bound by these Terms and Conditions. Not agreeing to these Terms and Conditions denies you the right to use our website or make a purchase.
Modification of Terms and Conditions. LOCA reserves the right to modify these Terms and Conditions at any time without prior notice. Any changes made to the website will take effect immediately and by using our website or making a purchase, after such changes have been made, you agree to be bound by our revised Terms and Conditions.
II. PRIVACY POLICY
Collection of Information. LOCA may collect personal information from users, such as name, email address, shipping and billing addresses. We collect this information to process your purchases and provide customer support.
Use of Information. LOCA will not sell, trade, or rent the users' personal information to third parties without the users’ consent, unless required by law. However, we may use the users' information to send promotional materials, at the users' discretion.
Security of Information. LOCA uses reasonable security measures to protect the users' information from unauthorized access, use, or disclosure. However, users should be aware that no security measures are foolproof or impenetrable. Therefore, LOCA cannot guarantee complete security of all the users’ information.
III. PAYMENT AND SHIPPING
Payment Methods. LOCA accepts a variety of payment methods, including credit cards, debit cards, and digital wallets. Payment processing is handled by third-party payment processors, and users are subject to their terms and conditions.
Shipping and Delivery. LOCA ships products nationwide. We ship orders every Saturday, and shipping fees and delivery times vary depending on (1) the shipping destination, and (2) the shipping method chosen by the user. Metro Manila shipments usually arrive within 2 to 3 days of shipping, while shipments to provincial areas may take a few days longer. It is the user's responsibility to pay any customs fees, taxes, or duties associated with the receipt of their order.
Returns and Exchanges. LOCA offers a 7-day return policy for unworn, undamaged, and unwashed products. Users must contact LOCA within 7 days of receiving their order to initiate a return or exchange. Return shipping fees will not be shouldered by LOCA and should be paid by the user. Since the order has already been shipped to the customer, shipping rates applied at checkout will not be refunded.
IV. INTELLECTUAL PROPERTY RIGHTS
Copyright. The content and design of the website, including but not limited to text, graphics, logos, images, and videos, are the property of LOCA and are protected by copyright laws. It is forbidden for any user to reproduce, distribute, or create derivative works based on the content of the website without the signed written consent of LOCA.
Trademarks. The LOCA name and logo are trademarks of LOCA, and may not be used without the signed written consent of LOCA.
V. DISCLAIMER AND LIMITATION OF LIABILITY
Disclaimer. LOCA makes no warranties, either express or implied, as to the accuracy, completeness, or reliability of the information contained on the website or the products offered for sale. LOCA shall not be liable for any damages, losses, or injuries arising from the use of its website or products.
Limitation of Liability. LOCA shall not be liable for any direct, indirect, special, incidental, consequential, or punitive damages arising out of the use of or inability to use its website or products, whether or not LOCA has been advised of the possibility of such damages.
VI. GOVERNING LAW AND JURISDICTION
Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
Jurisdiction. It shall be the exclusive jurisdiction of the Philippine courts to settle any dispute arising from or in connection with these Terms and Conditions.
